Nimbus Shield Terms of Use

You must be legally capable of agreeing to these Terms.

Nimbus Shield is not directed to children under 13. A minor may use the application only with appropriate involvement and permission from a parent or legal guardian and subject to applicable law.

If you permit another person to use Nimbus Shield on your device, you are responsible for their use of the application.

Nimbus Shield is a personal health-tracking and informational tool designed to help users:

• Record migraine-related information
• Organise personal observations
• Review historical entries
• Identify possible patterns or correlations
• Create summaries and reports
• Use optional on-device voice transcription
• Prepare information they may choose to discuss with a healthcare professional

Nimbus Shield provides observational information based on data entered by the user. Results depend on the accuracy, completeness, consistency, and amount of information recorded.

Nimbus Shield is not a medical device and does not diagnose, treat, cure, or prevent any medical condition.

Nimbus Shield does not provide medical advice, diagnosis, emergency monitoring, medication instructions, or treatment recommendations.

App-generated patterns, correlations, evidence indicators, alerts, explanations, and reports may be incomplete or inaccurate, may reflect coincidence rather than causation, may be affected by missing or incorrectly entered information, and are not a substitute for professional judgment.

Always consult a qualified healthcare professional for medical advice, diagnosis, treatment, medication decisions, or questions about symptoms. Do not start, stop, increase, reduce, or otherwise change medication or treatment based on Nimbus Shield.

Nimbus Shield is not an emergency service and is not designed to detect or respond to emergencies.

Do not rely on the application to identify a dangerous condition, send an emergency alert, contact another person, or summon medical assistance.

If you believe you may have a medical emergency, contact local emergency services immediately.

You are responsible for:

• Entering information accurately and reviewing it before saving
• Reviewing generated findings critically
• Verifying information and export redactions before sharing
• Selecting appropriate recipients for exports
• Protecting your device with an appropriate screen lock and security updates
• Maintaining any records you need independently
• Seeking professional medical assistance when appropriate

You must not represent Nimbus Shield findings as a confirmed medical diagnosis.

Nimbus Shield primarily stores health information locally on your device.

Local information may be lost through device loss, theft, damage, or replacement; application deletion; Clear All Data; clearing Android application storage; operating-system failure; storage corruption; factory reset; security compromise; failed updates; unsupported device modifications; or other technical events.

Nimbus Shield is not a medical-record custodian, cloud backup provider, or guaranteed archival service. You are responsible for maintaining any independent records or exports you consider necessary.

Nimbus Shield may provide optional on-device voice transcription. Transcription can misunderstand words, dates, symptoms, medication names, dosages, durations, or other information. You must review and correct the transcript before saving it.

Do not rely on an unreviewed transcript for medical decisions or communication with a healthcare professional.

Availability and performance may depend on microphone permission, model availability, device performance, free storage, Android behaviour, and compatible native software.

Optional weather features may use foreground location or manually selected location information. Weather data may be delayed, unavailable, estimated, inaccurate, or supplied by a third party.

Weather correlations shown by Nimbus Shield do not establish medical causation. You may deny location permission and continue using core manual logging functionality.

Notifications and reminders are provided for convenience. They may fail, be delayed, be suppressed by Android, disappear after restart, or be affected by battery optimisation, permission settings, time-zone changes, manufacturer modifications, or device configuration.

You remain responsible for medications, appointments, medical care, and other actions. Do not rely on Nimbus Shield as the sole reminder for any health-critical activity.

Nimbus Shield may allow you to export or share text, JSON, CSV, images, or PDF files.

You are responsible for reviewing content, applying available redactions, selecting and confirming the recipient, understanding the receiving application's privacy practices, and obtaining permission before sharing information about another person.

Once information is shared outside Nimbus Shield, it may be copied, stored, forwarded, analysed, or disclosed by others. Nimbus Shield cannot recall or control externally shared information.

Nimbus Shield may include free features and optional paid features. Feature availability, limits, packaging, and pricing may change over time. Material changes will be handled in accordance with applicable law and app-store requirements.

Purchasing a subscription gives you a limited right to access the corresponding paid features during the applicable subscription period. It does not transfer ownership of Nimbus Shield or its software.

Subscriptions are purchased and billed through Google Play. Monthly or yearly periods may be offered as displayed at purchase.

Unless otherwise stated at purchase, subscriptions renew automatically; Google Play charges the payment method associated with your account; renewal follows the period displayed at purchase; pricing and applicable taxes are shown by Google Play; and you may manage or cancel through Google Play.

Deleting Nimbus Shield or clearing its data does not cancel a subscription. Cancellation generally stops future renewal, while paid access may continue until the end of the current billing period.

Nimbus Shield uses RevenueCat to validate purchases and determine entitlement status.

Nimbus Shield may offer trials, discounts, introductory pricing, or promotional access. Eligibility and duration may be determined by Google Play, RevenueCat, or the terms displayed with the offer.

Unless cancelled before the stated deadline, a trial or introductory offer may convert into a paid recurring subscription. Promotions may be changed or withdrawn where permitted by law, without retroactively changing a completed purchase contrary to applicable law.

Google Play processes subscription payments and handles refund requests under its policies and applicable law. Approval of a refund cannot be guaranteed.

Nothing in these Terms limits any mandatory refund, cancellation, or consumer right available under applicable law.

Nimbus Shield may provide a Restore Purchases function. Restoration depends on the Google Account used for the original purchase, Google Play and RevenueCat availability, valid purchase records, internet access, and technical compatibility.

Restoration may take time or temporarily fail. Contact [email protected] if a valid purchase is not recognised after reasonable troubleshooting. Do not send complete payment-card information or health records in a support request.

Nimbus Shield's handling of personal information is described in the Privacy Policy at https://zymric.com/nimbus-shield/privacy. The Privacy Policy forms part of these Terms.

You must not:

• Use Nimbus Shield unlawfully
• Attempt to bypass paid-feature controls or interfere with purchase validation
• Reverse engineer, decompile, or disassemble the application except where law expressly permits it
• Probe or exploit security vulnerabilities without written authorisation
• Distribute malware or harmful code
• Violate another person's privacy or share their health information without authority
• Misuse exports to harass, discriminate against, or harm another person
• Impersonate the app operator or falsely claim affiliation
• Remove proprietary notices
• Disrupt Nimbus Shield or connected third-party systems

Nimbus Shield is not designed, tested, or authorised for emergency monitoring; clinical diagnosis; autonomous treatment or medication-dosing decisions; hospital or clinical decision support; continuous patient monitoring; use as a regulated medical device; insurance or employment eligibility decisions; legal or forensic medical evidence; research involving human subjects without required approvals; or any situation where failure could reasonably lead directly to death, serious injury, or significant harm.

Nimbus Shield, including its software, design, interface, graphics, branding, documentation, original text, and application-generated presentation formats, is owned by or licensed to the app operator and protected by applicable intellectual-property laws.

You receive a personal, limited, revocable, non-exclusive, non-transferable licence to use Nimbus Shield for its intended purpose, subject to these Terms. You retain ownership of information you enter into the application.

You may voluntarily provide ideas, suggestions, or feedback. You grant the app operator permission to use that feedback to improve Nimbus Shield without restriction or compensation, provided this does not permit publication of your identifiable health information.

Do not include confidential health information in general product feedback.

Nimbus Shield may depend on Google Play, RevenueCat, application-update infrastructure, weather services, model-hosting services, optional analytics and crash-reporting services, and Android operating-system components.

Those services are governed by their own terms and privacy practices. The app operator does not control and is not responsible for third-party outages, policy changes, processing delays, account restrictions, or service discontinuation, except where responsibility cannot legally be excluded.

Nimbus Shield may receive updates to correct defects, improve security, change functionality, or comply with legal or platform requirements. Some updates may be necessary to continue using the application safely, and older versions may stop functioning or receiving support.

Not every feature is guaranteed to remain available indefinitely.

Nimbus Shield may add, modify, suspend, or discontinue features. Where a change materially affects an active paid subscription, reasonable notice or an appropriate remedy will be provided where required by applicable law or Google Play rules.

Nimbus Shield is provided subject to availability. Uninterrupted operation, compatibility with every Android device or modified device, error-free transcription or insights, continuous third-party availability or subscription validation, perfect data preservation, and permanent support for every Android version are not guaranteed.

Maintenance, security incidents, service-provider outages, or technical failures may interrupt operation.

To the maximum extent permitted by law, Nimbus Shield is provided on an 'as is' and 'as available' basis.

The app operator disclaims implied warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, reliability, availability, and medical suitability, to the extent such warranties may lawfully be disclaimed.

No statement in Nimbus Shield creates a doctor-patient, pharmacist-patient, therapist-patient, fiduciary, or other professional relationship. Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, the app operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising from Nimbus Shield, including loss or corruption of local data or exports; inaccurate entries, transcripts, or findings; missed notifications; device or third-party service failures; unauthorised device access; disclosure caused by user-directed sharing; reliance on Nimbus Shield instead of professional care; or medication or treatment changes.

Where liability cannot lawfully be excluded, it is limited only to the extent permitted by law. Nothing excludes liability for fraud, wilful misconduct, or another matter that applicable law does not permit to be excluded or limited.

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses resulting from your unlawful misuse of Nimbus Shield, violation of another person's rights, or unauthorised disclosure of another person's information. This provision does not apply where prohibited by consumer law.

The app operator may suspend or terminate access where reasonably necessary because of a material violation of these Terms, fraudulent purchases, attempts to bypass subscriptions, security threats, unlawful conduct, abuse of services, or legal or platform requirements.

Termination does not automatically cancel a Google Play subscription. You must manage cancellation through Google Play. You may stop using Nimbus Shield at any time and delete locally stored information using the available deletion tools.

The parties should first attempt in good faith to resolve a dispute by contacting [email protected]. Nothing in these Terms prevents either party from pursuing rights or remedies available under applicable law, and mandatory consumer rights remain unaffected.

If a provision is found invalid or unenforceable, it will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

Failure to enforce a provision does not waive the right to enforce it later.

You may not transfer your rights under these Terms without written permission. The app operator may transfer these Terms as part of a lawful restructuring, sale, or transfer of Nimbus Shield, subject to applicable privacy and consumer-protection requirements.

These Terms and the Privacy Policy form the agreement between you and the app operator concerning Nimbus Shield, except for additional terms displayed during a specific purchase or promotion. Google Play terms may also apply to purchases and distribution.

These Terms may be updated to reflect changes in Nimbus Shield, law, platform policies, security requirements, or business operations. The current version will be published at https://zymric.com/nimbus-shield/terms, and the effective or last-updated date will be revised when changes are made. Material changes may also be announced in the application where appropriate.
